Whats Next Labs LLC (owner of “Smarter" the Missed Call Assistant app) issues this Privacy Policy to inform you of our procedures and policies regarding the collection, disclosure, and use of personal information Whats Next Labs LLC receives or collects from users of our applications and/or website. The term “Services”, as used in this Privacy Policy, references both the https://smartersms.com website (the “Site”) and applications and all Whats Next Labs LLC applications, games and any other products or services offered by Whats Next Labs LLC (the “Application(s)”). This Privacy Policy applies to information that you provide to us (or permit third party sites to provide us) or that we collect through the Services. This Privacy Policy will be updated at dates in the future to be determined by Whats Next Labs LLC. We will notify you of any material changes by posting the new Privacy Policy on the Services. Whats Next Labs LLC recommends that you consult this policy periodically for any changes.

I. Information Collection and Use: Personally Identifiable Information

Information We Collect Automatically

Our products may require information or permissions from your device in order to function effectively.

Log Data: When you use our app, whether as a registered user or a nonregistered user our servers automatically record information that the Smarter app sends (“Log Data”). This Log Data may include information such as your computer’s Internet Protocol (“IP”) address, phone type, call log information, photos you request to upload and share, SMS / messages you requested the assistant to react to, or Contacts from your address book. This Log Data may also include the website or application you were visiting before you came to the Service, pages of the websites or applications involved in the Service that you visit, the time spent on those pages, information you search for, access times and dates, operating system, software version, unique advertising identifier, and other statistics.

Information That You Provide

As you use the Services, you may provide us with personally identifiable information. This refers to information about you that can be used to identify, track, or contact you (“Personal Information”). Personal Information includes data such as your name, phone number, contacts, photos and videos. When you contact our customer support services, this may include a record of communication correspondence and associated contact information.

We also collect other information that you provide in connection with your registration and/or use of the Services (e.g., without limitation, birthday, gender, zip code (on its own), individual preferences and certain information about your computer or mobile device, such as operating system, software version and unique advertising identifier) (“Non-Identifying Information”). Certain Non-Identifying Information would be considered a part of your Personal Information if it were combined with other identifiers (for example, combining your zip code with your street address) in a way that enables you to be identified. But the same pieces of information are considered NonIdentifying Information when they are taken alone or combined only with other non-identifying information (for example, your viewing preferences).

With your permission, we may access information from your device, such as your general location, contact lists, SMS messages, photo and video library, and/or calendar. This information is only accessed if you grant us access to it, and if it’s required for the service to operate, or required for specific features of the service to operate. For example, we cannot display, send or sync a SMS message on your behalf if you do not grant SMS permissions to us.

How We Use Your Personal Information:

We may use your Personal Information to provide products and services and to support our business functions. For example, we may use this information for the following ways:

  • Provide the Services to you - specifically managing SMS messages, contacts, photos and phone numbers. To do so we may upload messages, photos, contacts and phone numbers from your mobile device to our servers. Storing this information on our servers helps you access them from multiple devices, as well as support the functionality of the app. To remove or erase this Personal Information, please proceed with deleting your account. The delete account functionality is available in the Settings page that is accessible from the More tab in the Smarter app. This data is never made available to 3rd parties for commercial purposes, data sales, or to inform advertising targeting. Smarter is supported by subscribers, not ads.

  • Recognize you when you return to our Services, keep your game progress, save your registration ID and login password for future logins, and store information about your use of the Services

  • Display your achievements on leaderboards within the relevant Application (which will include your basic social media profile information if you choose to link your social media accounts with the Services)

  • Provide customer service

  • Operate, protect, improve, and optimize the Services and the user experience, such as by performing analytics and conducting research

  • Communicate with you and to send you information by email, postal mail, telephone, text message, or other means about our products, services, contests, support messages, updates, security alerts, and account notifications. If you decide at any time that you no longer wish to receive such communications from us, please follow the unsubscribe instructions provided in any of the communications or update your “user preferences” information. (See “Your Rights,” below.)

  • Make your user experience easier, more personalized, more enjoyable and more efficient

  • Address problems with and improve our products, brands, services and technologies, as well as to develop new products and services

  • Enable certain features of the Services in order to better understand how you interact with the Services and to monitor aggregate usage.

  • Facilitate your ability to share information to social media

  • Administer and fulfill our contests and other promotions

  • Help us learn more about your product preferences

  • Send you push notifications with app-related information when you give us permission

  • Fulfill your purchase requests and process refunds

  • Fulfill a contract we have with you

  • Operate, protect, improve, and optimize the Services and experience, and personalize and customize your experience. We conduct profiling based on your interactions with the Services.

    We process this information given our legitimate interest in improving the Services and our users’ experience, and where it is necessary, for the adequate performance of the contract with you.

    We process this information given our legitimate interest in protecting the Services, to measure the adequate performance of our contract with you, and to comply with applicable laws.

    Provide, Personalize, Measure, and Improve our Marketing.
     

  • Smarter is supported by our subscribers. We do not sell advertising in Smarter. Your contacts, messages and phone number is never used for advertising targeting, or made available to any 3rd party for commercial purposes.

  • Smarter can send you promotional messages we believe may be of interest to you, including marketing, advertising, and other information that may be of interest to you (including information about Whats Next Labs LLC or partner campaigns and services).

  • We may also administer referral programs, rewards, surveys, sweepstakes, contests, or other promotional activities or events sponsored or managed by Whats Next Labs LLC or its third party partners.

  • We will process your Personal Information for the purposes listed in this section given our legitimate interest in undertaking marketing activities to offer you products or services that may be of your interest.

    Other Purposes.
     

  • When you consent to it

  • When it is necessary to protect your vital interests or that of another person

  • When it is necessary to carry out your instructions

  • When it is necessary for the performance of a task carried out in the public interest

Whats Next Labs LLC Registered Users. If you register through the Services on the Site and submit your Personal Information to create a profile, for Whats Next Labs LLC or for any Whats Next Labs LLC applications, websites, or services, other registered users may see your “User Name” (“Subscriber Identifier”).

We may employ third party companies and individuals to facilitate our services, to provide our services on our behalf, to perform services related to our Services (e.g., without limitation, analytics and reporting services, database & hosting services, distribution platforms, and other web or app service providers) or to assist us in analyzing how our Services are used. These third parties have access to your Personal Information only to perform these tasks on our behalf and are obligated not to disclose or use it for any other purpose.   • Analytics Service Providers, including, but not limited to, Periscope, Inc., AppFigures, Inc., Google LLC (operating as Fabric, Firebase, Google Analytics, BigQuery, or Google Cloud Platform);

  • Web, App or Game Software, Hosting, Database & API Service Providers, including, but not limited to, OneSignal, Inc., Google LLC (Google Cloud Platform), Amazon.com, LLC (Amazon Web Services), Globotech Communications, Linode LLC, Salesforce.com, Inc. and

  • Customer Support Platforms, including, but not limited to, Zendesk, Inc., Helpshift, Inc., Uservoice, Inc.

Group Companies. We may share your personal information with our group companies where it is in our legitimate interests to do so to enable them to provide customer support to you or for internal administrative and management purposes (for example, for corporate strategy, compliance, auditing and monitoring, research and development, and quality assurance).

Whats Next Labs LLC cooperates with government and law enforcement officials and private parties to enforce and comply with the law. We will disclose any information about you to government or law enforcement officials or private parties as we, in our sole discretion, believe necessary or appropriate to respond to claims and legal process (including but not limited to subpoenas), to protect the property and rights of Whats Next Labs LLC or a third party, to protect the safety of the public or any person, or to prevent or stop activity we may consider to be, or to pose a risk of being, any illegal, unethical or legally actionable activity.

Business Transfers. Whats Next Labs LLC may sell, transfer or otherwise share some or all of its assets, including your Personal Information, in connection with a merger, acquisition, reorganization or sale of assets or in the event of bankruptcy.

IV. How Long We Store Your Information

Smarter users can delete their account at any time. Smarter accounts, which include stored messages, phone numbers and contacts. Other information, analytics, metadata and contact information is kept for no longer than necessary for the purposes for which the personal information is processed. V. Your Rights

​

In accordance with Whats Next Labs LLC’s policies and procedures, all registered users of Whats Next Labs LLC Services have the right to review, verify, correct, and request erasure of the Personal Information that we hold about you under certain circumstances. If you completely delete all such information, then your account may become deactivated. You also have the right to limit, restrict, or object to the processing of your Personal Information under certain circumstances. You may also have the right to request that we transfer your Personal Information to another party to the extent provided for under applicable data privacy laws.

There is no charge for most requests, but if you ask us to provide a significant amount of data, for example, we may ask you to pay a reasonable administrative fee.

Whats Next Labs LLC is concerned with safeguarding your information.
